End User Licence Agreement
1. Licence Grant
Infoholiks grants you a personal, non-exclusive, non-transferable, revocable licence to use the Kesho mobile application ("App") on devices you own or control, solely for your personal, non-commercial use, subject to the terms of this EULA.
2. Restrictions
You may not:
- Copy, modify, or distribute the App or any portion of it
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, lend, sell, or sublicense the App
- Use the App for any unlawful purpose
- Submit false, misleading, or fraudulent event listings
- Impersonate any person or entity on the platform
- Attempt to gain unauthorised access to any part of the App or its servers
- Use automated tools to scrape, crawl, or extract data from the App
3. User Content
As an organiser, you may submit event listings, descriptions, venue details, and images ("User Content"). By submitting User Content, you grant Infoholiks a worldwide, royalty-free licence to use, display, and distribute that content within the App.
You represent that:
- You own or have the right to submit all User Content
- Your User Content does not infringe any third party's rights
- All event information you submit is accurate and truthful
We reserve the right to remove any User Content that violates these terms or our community guidelines, at our sole discretion.
4. Organiser Responsibilities
If approved as an organiser, you agree to:
- Provide accurate and complete event information at all times
- Update or cancel events promptly if circumstances change
- Honour ticket sales and refund commitments to attendees
- Comply with all applicable Ugandan laws regarding public events
- Not list events that are illegal, deceptive, or harmful
Infoholiks reserves the right to suspend or revoke organiser status for violations of these terms.
5. Payments
Ticket purchases made through Kesho are processed via NexumPay using MTN Mobile Money or Airtel Money. By making a purchase you agree to NexumPay's terms of service. Infoholiks is not responsible for payment processing errors caused by third-party payment providers.
Refund policies for specific events are set by the organiser. Kesho does not guarantee refunds for cancelled events — disputes should be resolved directly with the organiser.
6. Intellectual Property
The App, including its name, logo, design, code, and content created by Infoholiks, is owned by Infoholiks and protected by Ugandan and international intellectual property laws. This EULA does not grant you any ownership rights in the App.
7. Disclaimers
The App is provided "as is" without warranties of any kind, express or implied. Infoholiks does not warrant that:
- The App will be error-free or uninterrupted
- Event listings are accurate or events will take place as described
- The App will meet your specific requirements
Kesho is a discovery and ticketing platform. We are not responsible for the quality, safety, or conduct of events listed by third-party organisers.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Infoholiks shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if we have been advised of the possibility of such damages.
9. Termination
This licence is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.
Infoholiks may terminate or suspend your account at any time for violations of this EULA or our community standards, without prior notice.
10. Governing Law
This EULA is governed by the laws of the Republic of Uganda. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts of Uganda.
11. Changes to This EULA
We may update this EULA from time to time. We will notify you of material changes via push notification or in-app notice. Continued use of the App after the effective date of any change constitutes your acceptance of the updated EULA.
